License Agreement

License Grant

If emonster health software is lawfully made available to you under this Agreement, downloading, installing, accessing, or using it constitutes acceptance. Subject to this Agreement, emonster grants you a limited, revocable, non-exclusive, non-transferable license to install and use that software on devices you own or control, only for lawful personal, business, or internal use permitted by the product and distribution channel.

The software is licensed, not sold. You do not acquire ownership of the software or any emonster intellectual property.

Restrictions

You may not copy, modify, adapt, translate, sell, rent, lease, sublicense, distribute, host, outsource, or create derivative works from the software except as expressly permitted by law or written permission from emonster. You may not reverse engineer, decompile, disassemble, bypass technical protections, remove proprietary notices, misuse APIs or data, interfere with service operation, or use the software for unlawful, infringing, harmful, or abusive purposes.

Ownership

emonster and its licensors retain all rights, title, and interest in and to the software, documentation, designs, code, trademarks, service marks, inventions, patents, content, and related intellectual property. All rights not expressly granted are reserved.

App Store and Platform Terms

If you obtain covered software through Apple or another app marketplace, your use is also subject to that marketplace’s terms. For iOS, iPadOS, macOS, watchOS, tvOS, and visionOS apps, Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.

Updates and Availability

emonster may provide updates, fixes, or new versions, but is not obligated to do so unless required by applicable law or a separate written agreement. Features may change, be suspended, or be discontinued. Some features may require internet access, third-party services, app marketplace availability, or a compatible device and operating system.

Privacy and Data

Information, if any, collected through covered software is handled according to the emonster health Privacy Policy and applicable product-specific privacy disclosures. This Agreement does not itself identify any particular category of information as collected; the applicable privacy disclosures control.

No Warranty

The software is provided “as is” and “as available”. To the maximum extent permitted by law, emonster disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and error-free operation.

Limitation of Liability

To the maximum extent permitted by law, emonster will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, device failure, or loss of goodwill arising out of or related to the software. emonster’s total liability for any claim will not exceed the greater of the amount you paid for the applicable software in the three months before the claim or USD $100.

Termination

This Agreement remains effective until terminated. Your rights under this Agreement terminate automatically if you violate it. Upon termination, you must stop using and uninstall the applicable software and delete any copies in your possession or control.

Export and Legal Compliance

You are responsible for complying with applicable export control, sanctions, privacy, intellectual property, and other laws that apply to your use of the software.

Governing Law

This Agreement is governed by the laws of the State of Washington, without regard to conflict of law principles, unless a written agreement with emonster states otherwise.
